We are a full-service exporter. We can arrange the purchase, importing/exporting, Thai customs and arrange all taxes and duties involved in the purchase of your vehicle or parts for your vehicle. We have our own packing facilities in Bangkok, so not only is our delivery process quicker and easier, you can also be assured that every aspect of the delivery is handled by us, and not a “third party” freight forwarder, who is not familiar with the sensitivity of vehicle packing and logistics.

As a courtesy, we handle containerization of your vehicle. If shipped via container, vehicles are secured inside weather-proof, sealed steel containers for their journey. Our team of professionals ensure that vehicles are loaded and secured in an appropriate manner to ensure a safe transit and arrival at destination. Each vehicle is assessed individually to ensure that the correct securing methods are employed. What ever type of vehicle is handled, Veteran, Vintage, Classic or Modern, each car will be secured in the correct manner.

We will handle things on our end and we expect our export customers to handle things on their end. Before purchasing any vehicle, you should be intimately familiar with the requirements of importing a vehicle into your country, so there are no rude surprises once the vehicle has arrived on your port.

Each country has its customs clearance laws, and regulations on importation of vehicles from Thailand and since we are exporting to over 100 countries in the world, we are unable to keep up with import regulations of each country. Please thoroughly investigate the requirements for importing a vehicle to your country, if you haven’t already. The majority of our export customers are dealers but we would be glad to deal with informed individuals who have made themselves aware of all the relevant laws.

Once the ship has arrived on your port, you need to arrange for Customs clearance and delivery. You will be notified a few days before the arrival of your vehicle by the agent. You can decide to use your own means to handle the container or utilize the services of our agents. You need to remember that there will be additional charges for terminal container handling, customs clearance, documentation and delivery. They are payable in the local currency to the handling agent. You need to act fast because ocean carriers only provide a few days to pick up the container from the port, unload it and return to the port before detention and demurrage charges start piling. If you have not done this before, it is better to hire either the shipping company’s agent or a freight forwarder who is experienced in clearance of vehicles from your port.

Ro-Ro vs. Container Shipping

We can ship our cars either via Ro-Ro (Roll on Roll Off) Car carrying boats or via 20′  or 40′ containers. Ro-Ro signifies that your car will be “rolled on” the specialized ocean vessel at the port of origin and “rolled off” at the port of destination. Ro-Ro service is not available for all ports and is less secure. g

Ro-Ro vessels are like floating car parks.  The vehicles are driven into the cargo hold of these special car transporting ship, where they are secured down for the trip. This freight method is aimed specifically at vehicles that are mobile and can easily be driven on and off the carrier. The charges for Ro-Ro vary depending on the CBM of the vehicle. Big vehicles cost more and small vehicles cost less, with vehicle weight generally having no bearing on the cost.

Advantage: Its only advantage is that it is relatively cheaper but in our opinion, not significant enough to mitigate its risks

Disadvantages:

  • Higher risk of parts and accessories theft. Emblems, badges and license plates are often stolen
  • Anything loose will most likely be stolen
  • Higher risk of loading and unloading damage
  • Vehicles get very dirty and oily
  • Does not go to all ports

Your car or truck is parked close to many other cars and small nicks are possible. It may not be a big deal in a used car but every little nick on a new car counts.

Roll on Roll Off Ship Jim Motors’ Vigo in a container

A container, on the other hand, is very secure. Car is secured, blocked and braced inside the container by our export packers before it is loaded inside the ship.

Containers can be used to transport vehicles however the charges are generally a little higher than Ro-Ro. One 20Ft container is loaded with a single vehicle which is strapped to the sides to stop it moving during transit. The cost of a container is a flat rate so the size of the vehicle is unrelated to the cost.

Container freight is usually used for new vehicles, higher value vehicles, very large vehicles or vehicles with expensive performance accessories.

Advantages:

  • More secure transport
  • Same cost for large cars
  • Lower risk of damage
  • Almost no risk of things being stolen off your vehicle during transit
  • More frequent shipping
  • More destinations
  • Vehicle arrives at its destination in exactly the same condition and state of cleanliness than when it was in when it was picked up

Disadvantage: Slightly more expensive

 

Export Flowchart

Exporting process goes this way: once you place an order, we will let you know if the vehicle is in our ready stock or needs to be acquired. We work together to figure out the various accessories that will need to be installed and create the final specifications of your required vehicle. An official Performa Invoice is now created and you send us the entire sum by Telegraphic Transfer (bank-to-bank-wire-transfer – TT). When the money is received, we take the vehicle through the mandatory registration/de-registration process that takes anywhere from 5 working days to up to 3 weeks to complete. As we wait for this process, we get all the accessories installed and reserve a container on the ship heading to your port. As soon as deregistration occurs, we load it into a container securely and send it your way.  Most ordered vehicles as Toyota Hilux Vigo G Auto and Manual are generally in stock and Toyota Fortuner and Mitsubishi Triton 3.2 can be acquired within a day if they are not already in stock. Other vehicles may take 2 to 3 days to acquire. Nissan Navara is currently in short supply so acquirig Navara will take some time.

Here are the steps:-

Call or email us to introduce yourself. Tell us if you are a dealer or a private individual and whether you are familiar with the import regulations in your country and have imported a vehicle earlier. We will let your know if and how we can do business

When you are ready, you discuss and submit details of your chosen vehicle (i.e.; air conditioning, power windows, manual transmission, body color, etc.) and accessories  you require. You also intimate your budget for the particular vehicles and we will steer you towards the right vehicle. Jim Account Manager reviews the request and fully establishes your purchase and delivery needs

If it is a new Toyota Hilux Vigo, Toyota Fortuner or Mitsubishi Triton, the chance is that we have them in stock already. If you are looking for a Jim Quality pre-owned vehicle, Jim Account Executive mounts a search to find a vehicle that meets your specifications. If a vehicle is already in one of our showrooms or export lots, we will quote you a price otherwise we will locate and price the vehicle

Once  a suitable car is found we contact you right away with vehicle’s specs and details. You must confirm it within a reasonable timeframe

If you are interested, we give you the chassis number and engine number and you confirm your decision to buy the vehicle. We work together to create vehicle’s final spec and once you agree, we send you a Performa invoice

You send 100% of agreed upon amount plus bank fees on both ends by Telegraphic Transfer (TT) within 36 hours. You sign and fax back the Sales Agreement and General Terms and Conditions

We acquire a temporary license plate and take it through the mandatory registration/deregistration process which takes 5-20 working days. Meanwhile we install accessories you have ordered

Car is placed securely in a container (or driven onto a Ro-Ro) with the next ship heading your way. Ratt and her staff have already organised all essential paperwork so car can be exported without a hitch on our end

We send you your keys and B/L via mail or courier (your choice but we recommend courier)

Shipping company notifies you of your car’s arrival. You pay shipping (if not paid in advance), import duty, VAT and other customs charges and retrieve your vehicle

If changes are needed to make it compliant with your country’s specifications, you take your prized possession to the nearest workshop that does compliance work and pay for agreed upon fees when picking up your vehicle

You get the vehicle insured and registered

You drive your inexpensive yet high quality Thailand-made vehicle with pride and make everyone in the block jealous!

You become Jim Motor’s Lifelong Customer and recommend us to your family, friends and customers and the above cycle begins again

 

Note, above steps are for “typical” transactions. Exceptions can be made for special circumstances.

Import/Export Procedures

Once a vehicle is purchased, the following typically occurs:

  • Depending upon a client’s needs and location, arrangements are made with land and/or sea carriers for vehicle delivery. Clients can choose their own carriers or we can handle all the arrangements. If they do pick their own carrier, they pay us local charges and deal with freight charges themselves. Please note that any delay in this case will not be our responsibility and warehousing charges may apply if your shipper does not take delivery
  • As a service to our clients, we also handle all the export and customs paperwork required for shipping the vehicle on our end
  • Upon delivery of vehicle to client’s home port, client may be required to fulfill the vehicle import requirements of his/her country.

General Terms and Conditions

Why the Legal Stuff
It’s important to note that certain terms and restrictions apply to all orders and purchases placed through Jim Motors. Due to the risks inherent in international commerce, it is necessary to anticipate possible problems. While we don’t generally encounter any problems during the purchase and export process, unforeseen issues may arise.  These terms and conditions are here to protect your interests – and ours, of course. The more you know, the better prepared you are to anticipate/handle any unforeseen issues. Again, while we certainly don’t expect any problems (there rarely are), it’s best to know what to expect.

[ 1 ] Individual Contract

Quantity, price, date of delivery, method of payment and other detailed terms and conditions shall be stated in sales note stipulated in Article 1 of this Sales Note, and such terms and conditions shall be finally binding upon both the parties. Seller in this contract is Jim Autos Thailand and the buyer is _____________.

[ 2 ] Order & Payment Methods

Any order shall not be binding unless and until accepted by Seller at its discretion. The Buyer shall remit a down payment equivalent to 100% of the afore-mentioned price in Thai Baht for the goods to the bank account designated by the seller within two ( 2)  working days from the effective date of this contract. All monetary transactions are to be conducted via wire transfer.

[ 3 ] Increased Costs

If Seller’s costs of performance are increased after the date of the contract by reason of increased freight rates, taxes or other governmental charges, and insurance rates including war risk, Buyer shall reimburse Seller for such increased cost or loss of income.

[ 4 ] Inspection

Seller shall, before shipment, make inspection of the goods especially in respect of specification, quality and condition of the goods. Unless otherwise arranged, the inspection by Seller shall be final in all respects regarding the goods.

[ 5 ] Delivery Terms

In case of F.O.B. terms, the Seller is not required to appoint any steamship company, carrier or vessel for shipment. But if the Seller should make such an appointment, the Seller is not responsible for late shipment due to delay or cancellation of such carrying boat. Further if requested by the Seller, the Buyer shall unconditionally remit the required payment and take full responsibility so that the Seller can make the necessary procedure to fulfill such shipment.

[ 6 ] Insurance & Freight

Insurance shall be effected by the Seller at buyer’s request and cost. War risk and / or any other risk additional to the foregoing shall be covered only at the specific request of the Buyer and at the Buyer’s expense. Any unforeseen increase in freight and / or insurance premium subsequent to the date of this contract shall be for the Buyer’s account.

[ 7 ] Assignment

Neither party hereto may assign to any third party this contract or any right or obligation under this Agreement, without prior written consent from the other party.

[ 8 ] Warranty

Any and all other warranties, express or implied, including but not limited to any implied warranty of merchantability or fitness for use of the goods, are hereby expressly disclaimed by the Seller.

[ 9 ] Claim against the Seller

Any claim of any sort shall not be alleged against the Seller arising from the use of information disclosed by the Seller in accordance with the terms of this contract whether such information is accurate or not.

[ 10 ] Failure by Buyer

If Buyer fails to perform any of its obligations of this contract, or in the event of demise, bankruptcy or insolvency of Buyer, dissolution or modifications of buyer or non-payment for the goods shipped, Seller shall have the right to cancel this contract with Buyer or to postpone the shipment, or to stop the goods in transit, and Buyer shall reimburse Seller for any loss, damage and expense sustained therefrom.

[ 11 ] Expenses

Buyer shall bear any expense relating to the payment to Seller under this contract, including Thailand’s withholding taxes and bank charges.

[ 12 ] Patents

Buyer shall hold Seller harmless from liability, loss or expense in connection with any alleged infringement with regard to any patent, trademark, copyright, design, pattern, etc., in any country.

[ 13 ] Force Majeure

In the event of Act of God, government orders or restraints, war or warlike conditions, blockage, hostilities, revolution, strikes, lockout, civil commotions, fire, flood, epidemics, breakdown, or accident or course of preparation or transportation of the goods, or of any other occurrence beyond Seller’s control, Seller shall not be liable for non-delivery or delay in performance of the contract caused directly or indirectly thereby, in which case Buyer shall accept the delayed shipment or the cancellation of all or any part of the contract.

[ 14 ] Jurisdiction

The parties hereto shall submit to the exclusive jurisdiction of the Bangkok District Court of Thailand with respect to any dispute arising from this contract.

[ 15 ] Jurisdiction and Arbitration

The relationship between Buyer and Seller in relation to the Products shall be governed by and construed in accordance with the laws of Thailand. Any legal action with respect to any transaction must be commenced within three months after the cause of action has arisen. The provisions of Thailand Commercial Law, and not the United Nations Convention on Contracts for the International Sale of Goods, shall apply. All disputes, controversies, or differences which may arise between the parties hereto, out of or in relation to or in connection with the contract, shall be finally settled by arbitration in Thailand in accordance with the Arbitration rules in vogue in Thailand. The award rendered by the arbitrator shall be final and binding upon both parties.

[ 16 ] Confidentiality

Without prior written consent from the other party, neither party hereto may disclose to any third party the Confidential Information received from the other party in the course of performance of this contract.

[ 17 ] Entire Agreement

This contract constitutes the entire agreement between the parties hereto with respect to the subject matter hereof and supersedes all prior agreements or understandings, expressed or implied, between the parties hereto.

[ 18 ] Governing Law

This contract shall be governed by and construed in accordance with the laws of Thailand.

[ 19 ] Amendment

This contract may not be amended except in writing signed by both parties.

[ 20 ] Accountability

Seller cannot be held liable, financially or otherwise, for any negligence, whether willful or unintentional, on its part or that of any other parties involved in any vehicle purchase and/or delivery transaction.

[ 21 ] Notice

All notice required hereunder shall be in writing and shall be sent by registered airmail, cable, telex or facsimile (and confirmed by registered airmail dispatched within three (3) days) to the addresses of the parties hereto shown in the beginning hereof. Notice given by airmail is deemed to be delivered to the recipient party seven (7) days from the dispatch thereof, and notice given by any means other than airmail is deemed to be delivered at the time of dispatch.

[ 22 ] Waiver

No waiver of any right hereunder shall be deemed to be a waiver of the same right on any other occasion. Remedies contained herein shall be cumulative, but not alternative.

[ 23 ] Severability

If any provision of this contract is later held invalid, the remaining provisions shall continue to be valid.

[ 24 ] Headings

The headings of the provisions in this contract are for convenience only and have no influence on the interpretation of the provisions.

Incoterms

The purpose of Incoterms is to provide a set of international rules for the
interpretation of the most commonly used trade terms in foreign trade. Thus, the
uncertainties of different interpretations of such terms in different countries can be
avoided or at least reduced to a considerable degree. The scope of Incoterms is
limited to matters relating to the rights and obligations of the parties to the contract
of sale with respect to the delivery of goods. Incoterms deal with a number of
identified obligations imposed on the parties and the distribution of risk between the
parties. In total 13 Incoterms have been defined which are grouped into four
basically different categories, applicable for sea and inland waterway transport or
for all modes of transport:

From top (EXW) to bottom (DDP) the point of transfer in the transport chain moves
from the sellers premises to the buyers place. The second and third group specify
the shipment conditions, with freight and insurance unpaid or paid. For the first 3
groups the risk of loss or damage during (sea) transportation are with the buyer of
the goods, whereas for the fourth group all risks up to delivery are with the seller of
the goods.

EXW (Ex Works) – Seller provides goods in his factory yard. Buyer is responsible for all the rest, including loading the goods onto trucks in the seller’s yards. Best to add: “loaded upon departing vehicle”.

FCA (Free Carrier) – Seller provides export licenses, customs clearances and port documents to first carrier (determined by buyer) in an agreed location within the export country. Useful for Multi Modal Transport (MMT) in land, air, or sea. Seller pays all port and customs inspection expenses. Seller’s responsibility ends with delivery to carrier. Buyer pays all expenses from point of delivery (transport, insurance, special inspections).

FAS (Free Alongside Ship) Seller delivers goods to a loading quay, alongside a ship, in an agreed port in export country. Buyer obliged to clear goods for export after having received loading documents from seller. Buyer pays all port expenses and expenses related to required documentation. Use only for marine freight.

FOB (Free On Board) – Seller delivers customs-cleared goods with bill of lading, export license, all taxes and duties paid clean (unharmed) on board a vessel. Seller pays all expenses until goods are clean on board. Buyer determines carrier and pays the carriage (including loading expenses if part of the transport costs). Marine freight only. Best to add: “stowed and trimmed”.

CFR (Cost and Freight) – Seller pays all expenses and transport costs to port of discharge. But responsibility for damage or loss or additional expenses is buyer’s after goods loaded and stowed under deck. Seller obtains customs and port clearances, licenses, contracts with the carrier and with the insurance company regarding transport of goods to the point of loading. Buyer must obtain the import licenses, release the goods in port of discharge, issue insurance and pay for transit and inspection of goods. Marine freight only.

CIF (Cost, Insurance, Freight) – Seller arranges marine freight insurance for buyer and provides buyer with valid insurance policy in addition to obligations under CFR. Unless otherwise agreed, seller buys a limited “C” policy. Best to add: “free out”. It is important to mention the type of insurance and coverage sought by buyer.

CPT (Carriage Paid To) – Similar to CFR but when MMT involved (car, train, ship and then airplane, for instance). Instead of On Board – use First Carrier.

CIP (Carriage and Insurance Paid To) – Similar to CIF but when MMT is involved. Responsibility reverts to buyer when goods delivered to First Carrier.

DAF (Delivered At Frontier) – Seller to deliver export cleared goods at a precise point at the border of either import or export country. Buyer obliged to clear goods through customs terminal, to obtain import license and to bear all import related duties, fees and charges. Seller must inform buyer ETD (Expected Time of Delivery) and precise location of delivery. If preceded by international marine or air transport, point of delivery will follow the Main Carriage (used in train transport).

DES (Delivered Ex Ship) – Marine freight only. Seller must deliver export cleared goods to buyer on board a ship in port of discharge but has no responsibility to clear the goods for import in the destination country, to unload them and to ship them to final destination within the buyer’s country.

DEQ (Delivered Ex Quay) – Marine freight only. Seller must deliver goods buyer outside the quay after unloading them from the ship and clearing them for import through port authorities and customs. Seller pays import taxes and port expenses. Seller must provide buyer with bill of lading and gate pass. Buyer must transport goods to his yards and if he does not must pay demurrage and warehousing.

DDU (Delivered Duty Unpaid) – Seller must deliver goods to buyer in a location within the destination country but buyer must clear them for import through the port and customs authorities. Buyers must pay all taxes and expenses related to the clearance.

DDP (Delivered Duty Paid) – Seller must deliver goods directly to buyer’s location (or to any other address) after having fully cleared them for import and fully paid all taxes and expenditures related to such clearance. Best to add: “DDP-VAT unpaid” in case seller does not agree to pay the VAT.

Bill of Lading (B/L)

Marine Bill of Lading (MBL) is:

  • Proof of receipt of goods in a certain condition

  • Proof of existence of transport contract

  • MBL facilitates the transfer of ownership

  • Negotiable, transferable and assignable

MBL is subject to the Hague conditions and MUST INCLUDE:

  • Name and address of sender

  • Port of loading and Port of discharge

  • Date of lading and place of issuance of bill of lading

  • Name of vessel and number of voyage

  • Identity marks of cargo

  • Description of goods – number of packing units, weight, volume

  • Condition of goods – statement of carrier (if not stated – the goods are in good condition)

  • “Clean on Board” not “Foul”

A Marine Bill of Lading must include these to be valid:

(a)   The words “bill of lading” and the words “lading” or “shipped” (which prove that goods have been loaded on board vessel)

(b)  Date of loading

(c)  Confirmation of the shipping company

(d)  Numbers of original bills of lading, if any

(e)   The words “Clean on Board”

(f)    Name of the shipper

(g)  Name of the consignee or “To Order” (of the shipper) together with endorsement of the shipper

(h)  Name of vessel

(i)     Port of loading, final destination and is re-loading required

(j)     Name of parties to be notified upon arrival to the port of discharge

(k)  Marks and numbers stamped on the packages

(l)     Abbreviated description of the goods (weight, number of units and volume / mass)

(m)           How many original copies of the MBL are there and is the presentation of all original copies required to in order to release the goods

Types of Bills of Lading (BL)

Shipped BL

– Goods are on deck of ship

Received for Shipment

– Prior to loading onto ship

Direct BL

From origin to destination, transshipment not allowed

Ocean Through BL

In case of transit involving a few carriers. In such a case, each carrier imposes its own conditions on each leg of the voyage and for the limited duration it handles the cargo.

Pure Through BL

First carrier must transport from port of loading to a mid-point and is responsible for damages to the goods.

Combined Transport BL

Pure BL which covers shipment by all means of transport (sea, air, land).

Forwarder BL

An agent’s BL. Issued by an international forwarder.

Freight Forwarder BL
