Albania Import regulations and customs duties

Regulations

Albania became a member of the World Trade Organization (WTO) in September 2000 and since then has liberalized its import regulations and customs regime according to WTO guidelines. By deciding to accede to the WTO, Albania has committed itself to the three basic rules of international trade:

  • transparency in laws,
  • equal rights and privileges for foreign and domestic firms and citizens, and
  • most-favored nation treatment.

The Directorate General of Customs (DGC) is the institution responsible for the management of the customs in the country and works under the Ministry of Finance. DGC is governed by the Customs Code of the Republic of Albania and its respective by-laws (Law No. 8449 of 27.01.1999). The Albanian Customs Code is inturn based on the Instruction of the Council of Europe EEC No. 2913/92 of 12 October 1992.

Customs duties

Customs duties are generally applied to almost all the products being imported into the country. The nomenclature of custom tariffs is largely based on the Harmonized System (HS).

Currently there are are 5 basic custom rates for imports depending on the type of the product:

0% , 2%, 5%, 10% and 15%.

The maximum rate of 15 percent is applied on products such as: textiles, jewelry and some food products. The lowest duty rate of 0 percent is applied mainly for humanitarian aid and waste processing equipment.

Albania being a signatory to the WTO’s Information Technology Agreement (ITA) requires the elimination of import duties on a wide range of information technology products, including software and computer hardware. In general for the importation of used computer equipment customs duty is assessed on 50 percent of the value of new equipment.

Note: The duty is assessed on the CIF (cost, insurance and freight).

Import taxes

Import tax at the rate of 1% is applied on all goods imported into the country.

Importers should fill out a Declaration Form of Goods for setting goods in free circulation. Customs officer carry on a physical check of the merchandize prior to allowing it to free circulation.

Excise and Luxury Taxes: For various imported luxury products such as soft drinks, alcoholic beverages, coffee, mineral water, perfumes, deoderants, automotive fuel and oil by-products, cigarettes and tobacco, excise taxes also are applied in addition to custom duties. Excise taxes are determined by the type and quantity of the product and range between 20-65 percent.

Regulations governing payments

The Bank of Albania (the country’s central bank) is responsible for managing the foreign currency. It along with all commercial banks licensed by it are authorised to carry out foreign payments. Payments between private individuals and legal entities are considered to be a civil-law relationship and are subject to the Civil Code (1994).

The use of foreign currency is allowed as means of payment within the country. There are no constraints on trading in hard currency. Every local or foreign person could own an unlimited number of accounts in any currency in any bank within the country.

The transfer of capital into and out of Albania can be carried out without any limitations. A non-resident person can open an account in the country, without limitations, in the domestic or foreign currency, in a local bank or a branch of a foreign bank licensed by the Bank of Albania and can buy or sell securities, etc

Tax on Foreign Cars Circulation

Border Customs agencies are in charge of collecting the tax on the circulation of foreign vehicles in the territory of Albania. Immediately after entering the territory of Albania individuals with foreign vehicles obtain an Entrance Certificate.

Individuals with foreign vehicles staying in Albania for no more than 60 days in a year are exempt from paying the circulation tax. They only pay one Euro when leaving the territory of Albania. For each day above the limit of 60 days, circulation tax is calculated as shown below:

  3. On passengers’ buses, tax charged is defined on reciprocity basis;

  5. In cases vehicles are not loaded, the tax charged is defined on reciprocity basis.

Import tax on Used Cars

The tax agents charged with collection of the import tax on used cars are the customs branches in border crossing. This tax is payable by the importer of the vehicle in the time of its clearance.
Tax on import of second hand vehicles is calculated as below.

  • For vehicles older than 10 years:
    • for other transportation vehicles not more than 10 seats (passengers), minibuses, vehicles for goods transportation up to 5 tons: 128 000 lek;
    • for buses and other means of goods transportation, with a transporting capacity over 5 tons: 160 000 lek;
    • for road tractors: 64 000 lek.
  • For vehicles with less than 10 years:
    • a) for other transportation vehicles not more than 10 seats (passengers), minibuses, vehicles for goods transportation up to 5 tons: 80 000 lek;
    • b) for buses and other means of goods transportation, with a transporting capacity over 5 tons: 80 000 lek;
    • c)  for road tractors: 48 000 lekë.

Tax on importation of vehicles (cars) is assessed according to the formulae: A fixed amount * engine cylinders *coefficient on the year of production.

  • A fixed amount of 20 thousand lek on any imported benzene- supplied car, and 25 thousand lek on any imported diesel- supplied car.
  • Engine cylinder implies burning capacity volume of the engine expressed in cubic centimeter.
  • Number of years that vehicle has been used implies the difference between the year when the vehicle or car enters an Albanian customs house and that of its production.

The coefficient on the number of years in use is as follows:

  • Up to two years from date of production, the coefficient is             0,0016
  • More than two years up to four years from the date of production   0, 0024
  • More than four years up to seven years from the date of production            0,0029
  • More than seven years up to ten years                                                            0,0032
  • More than ten years                                                                                        0,0048

20. TAX ON CHANGEOVER OF OWNERSHIP RIGHT

This tax is applied to any change of ownership of means. The tax on changeover of ownership is collected at the moment when the document on the changeover of ownership (by the notary act of sale, donations or other similar means) is submitted to the Regional Directorate of Road Transport for further procedures to be provided with a new circulation permit.

For the movable property (vehicles) this tax is 2% of the value of the transferred property and it is paid at the moment when this transfer is finished.

22. CARBON TAX

It is fixed at 0,5 leks per liter for petrol and benzene and one(1) lek per liter for gasoline.

Albania is not yet a part of the European Union

The European Union is composed of 27 independent sovereign countries which are known as member states: Austria, Belgium, Bulgaria, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, and the United Kingdom.[22] There are three official candidate countries, Croatia, the Former Yugoslav Republic of Macedonia, and Turkey. The western Balkan countries of Albania, Bosnia and Herzegovina, Montenegro, and Serbia are officially recognised as potential candidates.. The Faeroe Islands, Greenland, the Canary Islands, the British Channel Islands and the Åland Islands are not part of the EU customs area. They are regarded as areas outside the EU. There are also some small areas of some EU countries that do not belong to the EU customs area either. The customs rules applying to areas outside the EU are the same as those applying to countries outside the EU.

European Union Customs Duty

The European Union is a customs union which means that the same import duty rates are applicable in all member states.

European Union Tariff Rates

Motor vehicle imports from non-EU and non-EFTA countries are subject to common external tariffs (CET) that range from 5.3 to 22 percent.

  • Passenger Cars: 10%: passenger cars 12.5%: electric-motored cars
  • Trucks: The CET for diesel- and gas-engine trucks is either 11 or 22 percent, depending on the vehicle engine capacity.
    • 11%: diesel or semi-diesel trucks with an engine capacity of 2.5 liters and below; gas-engine trucks not exceeding 2.8-liter engine capacity
    • 22%: diesel or semi-diesel trucks with an engine capacity exceeding 2.5 liters; gas-engine trucks exceeding 2.8 liters
    • Dump trucks are subject to either a 6 or 17 percent duty, depending on engine capacity
    • 6%: dump trucks with an engine capacity of 2.5 liters and below 17%: dump trucks with an engine capacity exceeding 2.5 liters
    • All trucks made specifically for the purpose of transporting highly radioactive materials are subject to a 5.3 percent CET.

EU’s Single Internal Market (“EC-92”) and the Type-Approval Directive

The EU’s single internal market became official on January 1, 1993. Part of the “EC-92” effort includes the initiative to remove technical barriers to the free movement of products within the EU. The program’s greatest impact on the automotive sector has been in the area of standards. The EU Commission has attempted to harmonize automotive technical and environmental standards between the member states. EU legislation also covers noise and particulate emissions, as well as safety. For example, as of January 1, 1993, all motor vehicles in the EU must have a catalytic converter.

In addition, the EU’s type-approval directive (EU Council Directive 92/53) eliminates the need for national type-approval requirements by establishing one set of rules for automobiles and their parts throughout the EU. This directive aims to clarify the type-approval procedure for motor vehicles, separate technical units (i.e., trailers), and components. It simplifies the documentation, designates the type-approval number on a separate technical unit as certification of conformity, and defines vehicles, separate technical unit(s), and component(s). Certificates of conformity, as specified in Annex IX of EU Directive 92/53, will be required in order for an automobile to enter into service. For component approvals, an approval issued under relevant regulations of the U.N. Economic Commission for Europe (UNECE) is recognized as equivalent to an approval granted under comparable EU legislation.

In March 1992, the EU Council formally adopted the few remaining pieces of component-related legislation necessary to make whole-vehicle type approval a reality for passenger cars. In June 1992, EU member state officials approved the adoption of EU legislation creating a single system for certifying that passenger cars meet safety and other technical requirements. The legislation established a EU type-approval system to replace the twelve member state national schemes.

In 1996, the EU type-approval system became mandatory. Vehicles with EU type-approval can be marketed anywhere in the Community. Therefore, a vehicle need only receive type-approval certification in one EU country to be accepted in all other member countries. To receive type-approval, products may either be brought to a testing facility or manufacturers may opt to maintain their own approved, on-site equipment. Nevertheless, U.S.-and EU-origin automobiles must still be certified to this single set of rules by an authorized member state agency. A similar system was adopted for type-approval of two and three wheeled vehicles, and became effective on January 1, 1994. Value-added taxes (VAT)

As part of the establishment of the single internal market, the EU member states have also begun to harmonize their VAT rates into a narrow band of approximately 15 percent. Until that time, VAT rates are country-specific, and in some cases, sector-specific; the rates fluctuate between standard, reduced and luxury VAT rates. However, standard VAT rates are generally applied to vehicles throughout the EU. EU VAT rates currently range from 15 to 25 percent. VAT rates for each EU member are listed below:
