Belgium
Situated in northwestern Europe, Belgium has an area of 30,510 sq km (11,780 sq mi) and extends 280 km (174 mi) SE–NW and 222 km (137 mi) NE–SW. Comparatively, the area occupied by Belgium is about the same size as the state of Maryland. Belgium borders on the Netherlands to the N, Germany and Luxembourg to the E, France to the S and SW, and the North Sea to the NW, with a total boundary length of 1,385 km (859 mi).
Belgium is a part of the European Union
The European Union is composed of 27 independent sovereign countries which are known as member states: Austria, Belgium, Bulgaria, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, and the United Kingdom.[22] There are three official candidate countries, Croatia, the Former Yugoslav Republic of Macedonia, and Turkey. The western Balkan countries of Albania, Bosnia and Herzegovina, Montenegro, and Serbia are officially recognised as potential candidates.. The Faeroe Islands, Greenland, the Canary Islands, the British Channel Islands and the Åland Islands are not part of the EU customs area. They are regarded as areas outside the EU. There are also some small areas of some EU countries that do not belong to the EU customs area either. The customs rules applying to areas outside the EU are the same as those applying to countries outside the EU.
European Union Customs Duty
The European Union is a customs union which means that the same import duty rates are applicable in all member states.
European Union Tariff Rates
Motor vehicle imports from non-EU and non-EFTA countries are subject to common external tariffs (CET) that range from 5.3 to 22 percent.
- Passenger Cars: 10%: passenger cars 12.5%: electric-motored cars
- Trucks: The CET for diesel- and gas-engine trucks is either 11 or 22 percent, depending on the vehicle engine capacity.
- 11%: diesel or semi-diesel trucks with an engine capacity of 2.5 liters and below; gas-engine trucks not exceeding 2.8-liter engine capacity
- 22%: diesel or semi-diesel trucks with an engine capacity exceeding 2.5 liters; gas-engine trucks exceeding 2.8 liters
- Dump trucks are subject to either a 6 or 17 percent duty, depending on engine capacity
- 6%: dump trucks with an engine capacity of 2.5 liters and below 17%: dump trucks with an engine capacity exceeding 2.5 liters
- All trucks made specifically for the purpose of transporting highly radioactive materials are subject to a 5.3 percent CET.
EU’s Single Internal Market (“EC-92”) and the Type-Approval Directive
The EU’s single internal market became official on January 1, 1993. Part of the “EC-92” effort includes the initiative to remove technical barriers to the free movement of products within the EU. The program’s greatest impact on the automotive sector has been in the area of standards. The EU Commission has attempted to harmonize automotive technical and environmental standards between the member states. EU legislation also covers noise and particulate emissions, as well as safety. For example, as of January 1, 1993, all motor vehicles in the EU must have a catalytic converter.
In addition, the EU’s type-approval directive (EU Council Directive 92/53) eliminates the need for national type-approval requirements by establishing one set of rules for automobiles and their parts throughout the EU. This directive aims to clarify the type-approval procedure for motor vehicles, separate technical units (i.e., trailers), and components. It simplifies the documentation, designates the type-approval number on a separate technical unit as certification of conformity, and defines vehicles, separate technical unit(s), and component(s). Certificates of conformity, as specified in Annex IX of EU Directive 92/53, will be required in order for an automobile to enter into service. For component approvals, an approval issued under relevant regulations of the U.N. Economic Commission for Europe (UNECE) is recognized as equivalent to an approval granted under comparable EU legislation.
In March 1992, the EU Council formally adopted the few remaining pieces of component-related legislation necessary to make whole-vehicle type approval a reality for passenger cars. In June 1992, EU member state officials approved the adoption of EU legislation creating a single system for certifying that passenger cars meet safety and other technical requirements. The legislation established a EU type-approval system to replace the twelve member state national schemes.
In 1996, the EU type-approval system became mandatory. Vehicles with EU type-approval can be marketed anywhere in the Community. Therefore, a vehicle need only receive type-approval certification in one EU country to be accepted in all other member countries. To receive type-approval, products may either be brought to a testing facility or manufacturers may opt to maintain their own approved, on-site equipment. Nevertheless, U.S.-and EU-origin automobiles must still be certified to this single set of rules by an authorized member state agency. A similar system was adopted for type-approval of two and three wheeled vehicles, and became effective on January 1, 1994. Value-added taxes (VAT)
As part of the establishment of the single internal market, the EU member states have also begun to harmonize their VAT rates into a narrow band of approximately 15 percent. Until that time, VAT rates are country-specific, and in some cases, sector-specific; the rates fluctuate between standard, reduced and luxury VAT rates. However, standard VAT rates are generally applied to vehicles throughout the EU. EU VAT rates currently range from 15 to 25 percent. VAT rates for each EU member are listed below:

Registering a vehicle in Belgium
Registration of the vehicle is then handled by the DIV. It records the vehicle as on the road in Belgium and also issues the number plate (plaque d’immatriculation/inschrijvingsplaat). In Belgium the licence plate remains the property of the owner and can be transferred to another vehicle in the event of a sale/purchase. Again this process is handled by the DIV. In order to register a vehicle in Belgium and therefore to receive a licence plate, the following documentation must be presented to the DIV:
- Proof of residency
- A certificate of conformity for the vehicle (attestation de conformité/attest van conformite) This is usually supplied by the vehicle manufacturer or local agent. Many will ask for a copy of the registration documents
- The invoice/proof of purchase for the vehicle
- The vehicle’s original registration certificate (certificat d’immatriculation/inschrijvingsbewijs)
- Evidence of insurance cover, provided by a Belgian insurer
- Customs clearance forms, provided by the Customs department
- A vehicle-roadworthiness certificate (controle technique/Autokeuring). To find a local testing centre: Click here
- The registration application form. This is available from the DIV, from roadworthiness test centres or from insurance companies. It must have the customs and insurance stickers attached. There is just one application form which covers all types of vehicle (cars, scooters) and all situations (new, second hand and imported)
- The required fees. This will include a one-off introduction tax (taxe de mise en circulation/belasting op de inverkeerstelling) and an annual road tax (taxe de circulation/verkeersbelasting) dependent on the size of the vehicle’s engine
- Fiscal tax stamps (available from Post Offices)
Note: Copies of documents are not accepted.
As long as all these documents are in order the licence plate will be issued within a few days and will be sent in the post if a postal application has been made. If application is in person then the licence plate can be issued on the spot by the DIV office. The plate then needs to be attached to the rear of the vehicle and a second one needs to be made up for the front, at the owner’s cost.
Importing Vehicle as a new Belgian Resident
First, you should know that you must formally import your vehicle within 6 months of becoming a Belgian resident. I didn’t bother, and got myself in considerable trouble with the authorities.
The import process is complex but not impossible. However, a number of agencies are involved, and while individuals were invariably helpful where their own department was concerned, nobody seemed to have a grasp of the complete process and to be able to advise helpfully overall. So read on…
Your first port of call is the local Douane. There are large offices in the cities and smaller depots in the various ports. I recommend the latter, as the officer in charge generally has not got much else to do! You need to bring three documents, namely:
- Your original car registration document.
- An Aanvraag aan Verzekering. This is a document showing that you have applied for car insurance. The best place to go for this is your bank; they tend to be very helpful, as of course they want the business, and will help you to fill the form in. This document also provides insurance cover for 28 days.
- A Bewijs van Inschriving. This is proof that you have registered as a Belgian resident. The document is easily obtained; it will be given on request at your local town hall. Incidentally, an identity card will not do.
On production of these you are now, after much official stamping, issued with an all-important ‘pink form’. If your car is for personal use, you do not have to pay any import charge (though there will, of course, be a tax bill later). You now need two further documents.
- A Certificate of Conformity. You get this from the nearest dealer for your make of vehicle; it confirms that your vehicle is ‘regular’ and conforms to EC standards. Again, the procedure is routine, but I found this the most troublesome step; there were long delays, loss of documents (twice), and a charge of 120 Euros. But you need this certificate before you can get the final document.
- A keuringsbewijs. This is your car’s certificate of roadworthiness. You have to go to a local keuring centre; your garage can direct you, but garages can’t do the test. You can’t make an appointment for the test, and sometimes you have to wait in a long line, so it’s advisable to set half a day aside for this.
When you have passed the test, the keuring centre will stamp your pink form. You then send off the form and your original registration document to the address on the form. A few days later your new registration document and a number-plate (only one) will drop on your doormat. This ‘official’ plate has to go on the rear of your car; your garage will make a duplicate for the front. Finalise your insurance, and that’s it.
A final warning: if you don’t import your car within the statutory six months, you risk the potentially serious charges of evading road tax and of driving while uninsured (you have to have Belgian car insurance). If you had been continuing to pay road tax in your country of origin, and had the receipts, you could get away with a smaller fine.

Duty and Tax exemption as a general rule
Provided legal conditions are met, exemption from all duties and/or taxes is the rule, for the clearance through Belgian Customs of the following goods, when destined to the household or personal use of newcomers and their family, at the exclusion of any commercial or economic use:
– Private goods : personal effects, furniture, household equipment and linen, provisions corresponding to the normal supply of a family (the exemption does not apply to alcoholic beverages and tobacco products), domestic animals, saddle horses, portable instruments for arts and crafts necessary for the practice of the applicant’s profession, motor vehicles with a maximum speed of 40 km/h such as mopeds and other 2 to 4 wheels-vehicles with engine capacity of 50 cc or less, electric vehicles with maximum weight of 400 kilos, without batteries;
– Private vehicles : private cars including trailers, motor-homes, camping cars, caravans, motor-cycles with engine capacity above 50 cc, pleasure boats, sports aircraft.

Legal conditions for the exemption of personal goods
– The applicant must have has his “normal residence” in another country for at least 12 months.
– The applicant must be moving his normal residence to Belgium.
– Personal goods must have been bought in the country of origin or elsewhere, with payment of local duties and/or taxes. Duties and/or taxes must not have been refunded later
– Previous possession/use of the personal goods must have lasted for at least 6 months.
– The personal goods must be declared for consumption (in other words, cleared through Customs) within the 12 months that follow the newcomer’s registration as resident in Belgium.
– The goods may be introduced in several shipments.
– For the 12 months that follow the granting of exemption, none of the personal goods can be disposed of in any manner (lent, rent, deposited as security, sold or given) unless Belgian Customs have been informed. Except in approved circumstances, duties and/or taxes will be payable.
Formalities
Before the introduction of the personal goods or at the time of importing them, the applicant must submit to the Head of the local Customs office, the following documents, in French, Dutch or German, depending on the area :
– Declaration IM/EU 4 (Regime 40) if the goods originate from a country outside the european Union. The signature of the applicant is required on the declaration, which must refer only to the personal goods. Separate, provisional declarations must be submitted for private vehicles.
– Five (5) signed copies of a “complete list” which consists of an “introductory statement” of the actual list of all goods to be declared, including private vehicles and of a “concluding statement”. It is often sufficient to make use of the plurilingual version of the standard list of household goods provided by international moving companies. The list must specify whether the goods are (will be) imported as one or as several shipments.
– Documents must be produced to satisfy Customs that the applicant has had his normal residence abroad for at least 12 months and has received or is in the process of receiving resident status in Belgium.
– The head of the local Customs office may also require proof of a) the address indicated, in the country of origin and in Belgium, b) the identity of applicant and c) the authenticity of the signature(s). In this respect, the applicant is advised to have his signature legalized in his country of origin by a local notary public or by a Belgian diplomatic mission.
Special formalities for private vehicles
Application for the exemption
The applicant will need
– An invoice or any other document supplying evidence that duties and/or VAT have been paid at the time of purchasing the vehicle(s) and that no refunds have subsequently been received by reason of the shipment to Belgium. In other words, that the vehicle has not been bought “in transit” in the country of origin.
– A document furnishing proof of compliance with the requirement of 6 months’ possession and use in the country of origin, such as insurance policy, certificate of title, receipt for the payment of a circulation tax, etc…
– Any document giving evidence of compliance with legal conditions that he or she had his or her normal residence in another country for at least 12 months and that he or she is moving his or her normal residence to Belgium.
The applicant will have to submit the documents listed above to the local Customs office together with a “declaration” using Form IM/EU 4.
Pending the decision of the regional Customs office, the local Customs office will issue a “provisional release document 139B” together with a stamped copy of the declaration form IM/EU 4. Both documents should be carried in the vehicle at all times.
Customs clearance of permanently imported vehicles
After the exemption has been granted, formalities for the permanent clearance of the vehicle will have to be carried out at the local Customs office.
On the form IM/EU 4, the applicant must subscribe to the commitment not to dispose of the vehicle during 12 months.
If the vehicle is a motor vehicle destined for road traffic, one of the documents delivered to the applicant by the Customs office will be an “Attestation 705” which is a “vignette/kleefzegel” (self-adhesive label), proving that the vehicle is legally imported and may therefore be registered.
Registration
At this stage, the vehicle has been cleared through the Belgian Customs, but the owner is still using the former registration documents and plates.
The final steps are the following:
– Obtaining a certificate of conformity
– Undergoing technical inspection
– Subscribing to an insurance policy
– Obtaining the registration of the vehicle.
a. Certificate of conformity
After the vehicle has received the modifications needed so as to conform to Belgian specifications, the certificate must be issued by the manufacturer’s subsidiary in Belgium; if this is impossible, it might also be delivered by one of the Technical inspection stations equipped to do so.
b. Technical inspection
Unless the certificate of conformity has been delivered by a technical inspection station, the privately imported vehicle, equipped with the certificate of conformity issued by the manufacturer’s subsidiary, must still undergo the technical inspection, at the station nearest to the owner’s residence.
The owner should bring the customs documents and the certificate of conformity.
At the technical inspection station, they will make sure that the car presents no safety or pollution problems (exhaust, rust, brakes, light, steering, …), does not need a change of tires (depth of grooves must be 1.6 mm minimum), and possesses all accessories imposed by Belgian law, i.e. a sealed fire extinguisher (less than 5 years old) with the logo Benor V (Belgian norms) and with a capacity corresponding to the size of the vehicle, a triangular danger signal (for breakdowns or accidents) and a first-aid kit, of a legally approved model.
The technical inspection will then issue a certificate of inspection, whereby the vehicle is allowed for one year on the roads; they will also make the applicant fill in and sign a registration application form, of pink color, which they will stamp and which must be submitted within two months to the D.I.V. of the Ministry of Transportations.
c. Insurance
All vehicles in use in Belgian roads must at all times, be covered by an insurance policy against third party liability.
From the moment the vehicle is to be driven with Belgian registration plates, the policy must be issued by a Belgian based insurance company, and the driver must be in possession of a “green card”, issued for the vehicle by the company. The official name of this documents is “international motor insurance card”. It testifies that the vehicle complies with legal requirements in Belgium (and abroad).
With the stamped pink registration application form, the applicant must go to the insurance company and subscribe a policy covering the “third party liability”.
d. Registration
Fiscal stamps must be affixed to the form by the applicant and the insurance company will add its stamp.
They will also deliver the application form and all the necessary supporting documents to the D.I.V. of the Ministry of Transportation.

– The officially stamped registration plate will be sent to the applicant along with the registration card (grey card).
– The stamped registration plate should be installed at the back of the vehicle. It is the applicant’s responsibility to have a duplicate made for the front of the car.
– A draft giro money-order will be mailed to the applicant for payment of the circulation tax.
– The grey card and the insurance certificate should be in the vehicle at all times.
– If the owner leaves the country or ceases to drive, the stamped plate and the grey card should be returned to the D.I.V. within 4 months.
– The certificate of conformity stays with the vehicle, as it is transferred to successive owners.
