Import Duty on Cars

Regulatory Framework

Every imported used vehicle must go through Pre-inspection by SGS. Control of the identification Imported Used  Vehicles ( CIVIO ) was implemented by the Government of the Republic of Cameroon and Société Générale de Surveillance SA (SGS) , following a rider to the contract between the two parties , signed September 2, 2002 and applied since 17 February 2003 . Through this text, the state mandates the SGS to establish an identification at  the arrival of used vehicles system ( categories B , C , D, E as defined by the Highway Traffic Act ) at the port of Douala. The Minister then camped the regulatory formalities. Ministerial Instruction No. 03/008/CF/MINFI/DD of 06 January 2003 establishing a procedure for the identification and evaluation of imported used vehicles specific clearance procedures induced by the implementation of this program , including the landing formalities , formalities to SGS , the formalities to Customs formalities removal , and various provisions, including the execution of motorcycles and mopeds ( class A ) category vehicles B specially equipped for handicapped driving ( class F ), agricultural tractors, construction equipment or commercial vehicles (category G).

Debarkation Formalities

–          Unloading of the vehicle from the vessel by stevedores

–          Apposition by SGS of a ticket with a serial number

–          Pre vehicle identification (17 characters)

–          Entry of the vehicle in the Car park

THE SGS Formalities

Removal Formalities
Exit of vehicles is carried out under the only responsibility of the stevedore on presentation of:
– The remove agreement
– The receipt of payment of customs duties and taxes
– Attestation secure clearance
– SGS ticket affixed to the vehicle

MISCELLANEOUS PROVISIONS
Excluded from identification  control categories below :
– Category A: motorcycles and mopeds ;
– Category F: category B vehicle specially designed for disabled use
– Category G: agricultural tractors , construction equipment and industrial vehicles
Shall remain and reported, all previous provisions including Article 9 of the Circular No. 001172/MINEFI/CAB of 15 May 1995 on exemption from monitoring the imports of used vehicles.

The SGS database will be available to all competent customs units to be used as a reference when evaluating imported vehicles

NOTICE TO IMPORTERS

This notice issued by Société Générale de Surveillance (SGS ) specifies the dock control procedure for identification and evaluation clearance of imported used vehicles in Cameroon by sea to the port of Douala.

SGS Cell of “Guichet Unique”

Deposit of import folder of the vehicle includes:
– The request of the identification card
– The original grey card + a photocopy
– Le “Connaissement Original” + photocopy
– Card + a photocopy of the taxpayer
– Freight bill + a photocopy

Payment of benefit

– Contribution to the issuance of an identification sheet 25,000 FCFA
– Giving a receipt acknowledgment
– Return of the original documents to the importer

Withdrawal of the secure identification sheet

– Two working days after the filing of the identification sheet provided with a receipt for the folder

Treatment of the case by the customs inspector on the base:
-The import declaration

Case of New Vehicles

The procedure for clearance of new vehicles is defined as follows:

• Establishing at the SGS, of an import declaration required for all goods whose FOB value is greater than one million CFA francs
• Send SGS an AVI
• Establishment of a model statement D03
• Deposit of the declaration in the main office of Douala Port 7 to competent customs clearance vehicles
• Payment of fees at the bank or Customs office
• Removal of the goods

The average tariff on vehicles, such as cars, trucks, motorcycles, as well as non-motor vehicles in Cameroon is 19.5333%, according to the 2011 WTO data.

Comparatively, the area occupied by Cameroon is slightly larger than the state of California. It is bordered on the N and NE by Chad, on the E by the Central African Republic, on the E and S by the Republic of Congo, Gabon, and Equatorial Guinea, on the SW by the Gulf of Guinea (Atlantic Ocean), and on the W and NW by Nigeria, with a total boundary length of 4,993 km (3,103 mi). The coastline accounts for 402 km (249 mi) of this length.

An Africa in miniature, the Republic of Cameroon contains examples of all the geography and people south of the Sahara: steamy equatorial jungles inhabited by pygmy hunters and the great apes; vast plains alive with African wildlife; white sand beaches; and Mount Cameroon, a still active volcano, rising 13,428 feet above sea level.

Each region is characterized by distinct societies: from the Muslim traders and pastoralists in the north; to the farmers and craft-makers of the west; to the forest peoples of the south. A cultural mosaic containing over 200 ethnic groups speaking 24 major African languages and three world languages — English, French, and Arabic — Cameroon’s only common feature appears to be its variety.

Cameroon’s two major cities are Douala and Yaounde. Douala, the most densely populated, is a major port of call along the coast of West Africa and is acknowledged to be Cameroon’s commercial center. Yaounde, situated in a lush hilly region in the interior, is the political capital and seat of government.

Cameroon became independent January 1, 1960, when East Cameroon (formerly French) became the Republic of Cameroon. On October 1, 1961, West Cameroon (formerly British) joined with East Cameroon to form the Federated Republic of Cameroon. With adoption of the constitution of May 20, 1972, the East and West formed a unitary republic. In January 1984, the National Assembly officially changed the country’s name by dropping the word “United” before the Republic of Cameroon. The 1972 constitution was amended in 1996.

Cameroon Duties

At beginning of 2011 Cameroon was supposed to reduce import tariff on brand new vehicles by 30%. Not sure if this was implemented or not.

In accordance with the trusteeship agreement between France and the United Nations, all nations had equal tariff treatment in Cameroon when it was a trust territory. Many types of goods essential for economic, social, and educational development were exempt from duty. Export duties were moderate. Despite this situation, the direction of Cameroon’s trade was to the franc currency zone and importers were required to secure import licenses for non-franc zone products. Following independence, the import licensing system was continued, but was lest strict for EU countries.

In 1994, Cameroon’s new Regional Reform Program included reduced taxes on imports from over 7% to 4%, and reduced the overall rate from a maximum 200% to a maximum 70% on luxury goods, and a minimum of 5% on necessities. Today, however, Cameroon employs the common external tariff (TEC) using four categories: necessities, 5%; raw materials and equipment, 10%; semi-finished goods, 20%; and finished products, 30%. There is also an excise tax, an indirect tax on consumer goods, of 25%, and a value-added tax that is generally 18.7%, but in some cases zero.

The 2000 Financial Law was designed largely to attract foreign capital, providing exemptions from export duties on bananas, cocoa, coffee, cotton, rubber, sugar, palm oil, and medicinal plants. Legislation to establish free trade zones was enacted in 1990. Prohibited imports include certain sanitary products, chemicals, toxic waste, some cosmetics, and some food items.

CUSTOMS TAXATION

In the area of customs taxation, Cameroun should take into account both its adhesion to the GATT and its participation in the customs and Economic Union of Central Africa.

Applicable duties and taxes

As UDEAC Member, Cameroun applies a common external tariff provided for by 1/92 UDEAC Act.

This external tariff applied by all Member States includes customs taxation and temporary surtax.

At present, applicable customs duties rates are fixed on the basis of goods CIF value as follows :

And current consumption goods 30%

Temporary surtax was introduced to enable UDEAC Member States to abolish quantitative restrictions starting from 1996. But the rate must not exceed 30% and the maximal and non renewable implementation period of this temporary tax extends over six years. The taxable base is similar to that of customs duties.

Cameroun also applies an import duty whose rate ranges between 5 and 90%.

Imported goods are also submitted to a turnover tax (TOT) of 10% on the basis of CIF value plus customs duties and import duty amounts.

Finally imported goods are subjected to other less important duties and taxes, such as inspection tax or computer tax.

5.2. Special provisions :

* UDEAC products covered by a corresponding certificate from a :

A total exemption from customs duties when they are included in the list provided by article 9 of the UDEAC Act n° 7/93 ;

Of a preferential tariff for other products ; this tariff is determined in percentage of the customs duty rate applicable to similar imported products of third countries. The constitutive UDEAC Act provides for a progressive reduction of this preferential tariff with a view to reducing it to 0% starting from 1998. The taxable base of this preferential tariff is the price exworks.

Prior to trade reforms, 4 taxes were levied on imports:

  1. Custom Duties (CD) levied on CIF value of the imported goods and varied from 5% to 20%;
  2. Imports Turnover Tax (IMTOT) was levied at 10% of the CIF value inclusive of Custom Duty, Entry Fiscal Duty and the complementary tax, it could be as high as 72% of the CIF value on what was deemed as a luxury import;
  3. the Entry Fiscal Duty (EFD) from 15% to 75% on the CIF value of imports; and
  4. complementary Tax (CT) of 40% of the CIF value of import

After trade liberalization, the Entry Fiscal Duty (EFD) was removed, now the customer had to pay only the Custom Duty (5% to 30% – see above table) and turnover tax (TOT). TOT was applied at three rates; zero for exempted good, reduced rate of 5% and a normal rate of 12.5%.

Benin Import Rules

A suppliers pro-forma invoice must accompany the application for an I/L. Most goods are subject to pre-shipment inspection. A Clean Report of Findings attesting satisfactory quality/quantity, inspection and price comparison is required.

Francophone goods and EU goods may be imported freely. Imports from all other countries are subject to an import licence. Imports from countries outside the French Franc Area valued over CFA Francs 500,000 must be registered with an authorised bank and the import certificate or licence, valid for 6 months, is issued by the Directorate of External Commerce.

Commercial Invoices

Show usual full details and all copies should bear the following declaration: “Nous certifions que les marchandises faisant l’objet de cette fourniture ont été fabriquées au pays suivant: [NAME OF COUNTRY] et que la valeur sous mentionnée est juste et conforme a nos écritures.” (Translation: We hereby certify that the goods to which this invoice relates were manufactured in [NAME OF COUNTRY] and that the value stated is correct and in accordance with our books.) To be signed by a director, secretary, partner, etc, and endorsed by an authorised Chamber of Commerce (see Where to Obtain Certificates of Origin under Certificates of Origin in Documents). Facsimile signatures are accepted by Customs. Customs require 2 copies. Other Information The full, completed Job Assignment Form, a copy of the invoice and the packing list should be sent to Bureau Veritas at their request. They will arrange for the inspections to be carried out by their UK office. At least five working days’ notice before the shipment of the goods should be given to Bureau Veritas by the exporter. Other Certificates Certificates of health required for certain foodstuffs livestock and plants.
