India Bharat Import Duty
India has 100 percent customs duty on all car imports irrespective of their engine capacity and brand.
In addition, India charges 12.5 percent VAT, 16.5 percent Excise Duty and other Para-Tariffs, including 16 percent CVD, four percent SCVD and three percent Education Cess. When it comes to used vehicles, India charges 100 percent basic import duty plus 32 percent addition duty and taxes.
There are detailed guidelines for importing a car in India. In brief, if the vehicle that has to be imported is new then it must conform to the provisions of the Motor Vehicles Act, 1988 and the rules made thereunder, as applicable, on the date of import. Some of the provisions include right hand steering, speedometer indicating in KM, photometry of lamps to suit keep left etc.
The import of new vehicles is permitted only through the Customs port at Nhava Sheva (Mumbai), Calcutta and Chennai. If the vehicle is second hand, it too should conform to the provisions of the Motor Vehicles Act, 1988 and the rules made thereunder, as applicable, on the date of import.
Import of second hand vehicles is allowed only through the customs port at Mumbai. The second hand or used vehicles imported into India should should not be older than 3 years from the date of manufacture and should have a minimum roadworthiness for a period of 5 years from the date of importation into India with assurance for providing service facilities within the country during the five year period.
In 2001 India lifted the QR (Quantitative Restrictions) on import of second hand vehicle as part of WTO compliance. In fact the market was opened in 2001 itself. The second hand vehicle and should have a minimum road worthiness residual life of 5 years.
The vehicle can be imported only from the country of manufacture. Importers should give guarantee of supply of spares. The vehicle should be subjected to testing in Vehicle Research and Development Establishment Ahmednagar or at Pune or at Budni (MP).
The present custom duty is 100% +surcharge +CVD etc makes the total duty at 180% of FOB value.
Non Resident Indian (NRI) returning to India and bringing his vehicle
The import duty is charged on the basis of list price prevailing. However, trade discount and depreciation on the value are deducted from the price list but freight from the country of manufacture and insurance charges are added. Autos of the capacity of more than 1600cc should have been owned and used by the shipper overseas for atleast one year. Cars which are less than 1600cc can be bought (new or second-hand) prior to arrival. Customs duty payable on cars is approximately 111% of the value assessed.
The landing charges are further added to arrive at the final assessable value. Depreciation allowed is as under:
Every quarter 1st year of use 4 Percent
Every quarter IInd year of use 3 Percent
Every quarter IIIrd year of use 2 1/2 Percent
Every quarter IVth year and thereafter 2 Percent
Customs Duty:
Basic Custom Duty 40 Percent
Special Custom duty 5 Percent
Additional duty 40 Percent
M.V. Cess 0.125 Percent
Special Additional duty of Customs 4 Percent
By and large the ex-factory price on the date of original purchase is taken into account while assessing the duty on a motor vehicle.

The value of the car is determined in the following manner:
- Manufacturer’s invoice value is accepted wherever such invoice is available.
- When no such invoice is available, value is determined on the basis of the world car catalogues available with the department or on the basis of manufacturer’s price list, wherever available. Normal Trade Discounts are allowed to be deducted where ever the value is taken on the basis of World car catalogues.
- Value of Second hand car is arrived at in the above manner after allowing the deductions for depreciation as per the schedule below, subject to maximum of 70%.

IMPORT POLICY
Passenger cars/jeeps/multi utility vehicles, etc., which are in the restricted category may be imported without a licence on payment of full Customs duty by the following categories of importers:
- Individuals coming to India for permanent settlement after two year’s continuous stay abroad;
- Resident Indians presented with a car as an award in any international event/match/ competition;
- Legal heirs/successors of deceased relatives residing abroad;
- Physically handicapped persons;
- Companies incorporated in India having foreign equity participation;
- Branches/offices of foreign firms;
- Charitable/missionary institutions registered with the Ministry of Welfare and the Ministry of Home Affairs, Government of India;
- Honorary Consuls of Foreign Countries on the recommendations of the Ministry of External Affairs, Government of India;
- Journalists/Correspondents of foreign news agencies having accredition certificate with the Press Information Bureau, Ministry of Information and Broadcasting, Govt. of India.
All the above categories shall be entitled to import only one vehicle except categories (e) and (f), which shall be entitled to import maximum of three vehicles. Persons in category (d) shall be entitled to import only specially designed vehicles suitable for use by handicapped. All such import shall carry a “NO SALE” condition of two years which shall be endorsed by the Customs Authorities on the passport/registration documents at the time of import and by the Regional Transport Authorities when such vehicles are presented for registration in India. All such imports, except by the physically handicapped persons, shall not involve any foreign exchange remittance from India directly or indirectly. The DGFT may, however, permit relaxation of these conditions or imports by any other category not listed in this Public Notice in special circumstances.
