Thailand top car exporter to JamaicaJamaica is an island in the Caribbean Sea situated about 145 km (90 mi) S of Cuba. It has a total area of 10,990 sq km (4,243 sq mi) and extends, at maximum, 235 km (146 mi) N–S and 82 km (51 mi) E–W. Comparatively, the area occupied by Jamaica is slightly smaller than the state of Connecticut. The total coastline is 1,022 km (634 mi).

Jamaica is the third-largest Caribbean island and lies nearly 600 miles south of Miami, Florida. Slightly smaller than Connecticut, the island is 146 miles long and 51 miles across at its widest point. Except for narrow coastal plains mainly on the island’s south side, the landscape is one of sharp, crested ridges, unique “cockpit” formations, and deep, twisting valleys. Almost half the island is more than 1,000 feet above sea level. Some 50% of the island is used for agriculture, 40% is woodland, and the remaining 10% is divided between mining and urban areas.

Kingston, the capital, is on the southeast coast and has the world’s seventh-largest natural harbor. From sea level at city center, the terrain rises to 1,800 feet. Jamaica’s 120 rivers flow to the coasts from the central mountain ranges.

Jamaica Import Rules

Used vehicles must be less than three years old (from date of manufacture). Incentives are in place to encourage import diesel cars (to increase fleet portion from 14% to 30%).

  1. An individual or company who intends to import a motor vehicle must first apply to the Trade Board for an Import Licence and receive same before making arrangements for the shipping of the vehicle to Jamaica. Trucks exceeding 3 tons, tractor heads and trailers do not require an Import Licence. Further information regarding Import Licences may be obtained from the Trade Board Limited, 4 Winchester Road, Kingston 10 or 30 Market Street, Montego Bay, St. James.
  2. Having obtained the Import Licence, the individual or the company may then make arrangements for the shipping of the vehicle to Jamaica.
  3. When the vehicle is imported into Jamaica, the importer must seek the services of a licensed customs broker to clear the vehicle through Customs. The broker will advise the importer of the information and documents required, the procedure to be followed, the port and wharf charges, the amount of duties to be paid to the Customs and the fee to be paid to the broker for his services.
  4. After the documents have been processed and the duties, charges and fees paid, the broker may then proceed to clear the vehicle from the wharf/airport, etc.

WARNING!

The individual or company will be in breach of Section 210 of the Customs Act if the vehicle lands in Jamaica without the Importer first obtaining a valid Import Licence. The importer of the vehicle will be liable to pay a penalty equivalent to three times the value of the vehicle and in addition the vehicle may be subject to seizure by the Commissioner of Customs.

Calculating tax and import duties

Under Section 19 of the Customs Act, “a duty of Customs is chargeable on the value of the imported goods at the time of importation. This duty is charged on the CIF (Cost, Insurance and Freight) value of the goods, when converted into Jamaican currency.” For example, if CIF=US$100 (US$1 to J$33) then total CIF=J$3,300.

Cost, Insurance and Freight (CIF)

  • Cost
    This is the total cost of the goods abroad including ex-factory price, commission, mark-up and inland freight but excluding sales tax and interest. The cost of the goods is sometimes expressed as FOB (Free on Board) or FOA (Free on Air).
  • Insurance
    This is the insurance charge which is payable in order to ensure that some compensation will be available to you in the event of the loss or damage of the goods. If you have not paid any insurance charges when sending your goods to Jamaica, an insurance charge is still applicable for valuation purposes. For goods arriving by boat, the insurance charge is 1.5% of the total paid or payable for the Cost and Freight (C&F), that is, if the goods cost US$100 + US$50 = US$150. 1.5% of US$150, i.e., 150×3/200 = US$2.25
    For shipments coming by air the insurance applicable is 1% of the total of the Cost and Freight.
  • Freight
    This is the amount of money paid or payable as freight to the shipping agent or the airlines for the goods to be shipped or transported to Jamaica.

Total CIF therefore is $100 + $50 + $2.25 = US$152.25.

Goods will attract different types of duties and taxes and the rates will vary according to the different types of goods. The duties and taxes are based upon a compounded system of taxable values. The following examples will indicate the method of calculation of duties and taxes.

For simplicity the CIF (Cost, Insurance and Freight) value of One Hundred Jamaican Dollars will be used in each example.

CIF.= Cost, Insurance and Freight ID = Import Duty ASD = Additional Stamp Duty GCT = General Consumption Tax SCT = Special Consumption Tax

Household Items for Personal Use

Stoves, fans (table or floor), washing machines, blenders, electric water heaters, turntables, radios attract Import Duty and GCT.

ID = CIF value x Import Duty rate = $100 x 25% $25 GCT = (CIF value + Import Duty) x GCT rate = ($100 + $25) x 15% = $125 + 15/100 = $18.75

Total payable is $25 + $18.75 = $43.75

The total of the Import Duty and GCT on these household items is 43.75%

N.B. The values for General Consumption Tax of items imported in commercial quantities by persons who are not registered taxpayers are subject to an uplift (mark-up) of 33 1/3% under the General Consumption Tax Act.

Goods Exempt from Import Duty

The Customs Tariff, Item 6 of the Second Schedule, allows for each passenger to receive duty concessions in respect of the following:

1. Reasonable quantity of wearing apparel, articles of personal adornment and toilet requisites whether new or used;

2. Instruments and tools to be used by him for the purpose of his profession, trade, occupation or employment, provided that they have been in his possession and bona fide use for a reasonable period;

3. Tobacco and some potable articles including wines and spirits in his baggage or on his person which he might reasonably be expected to carry with him for his personal use, in such quantities as the Commissioner may from time to time approve;

4. Used household effects which have been in the passenger’s use for a reasonable period of time and are not imported for sale;

5. A passenger who is eighteen (18) years or older and who is the holder of a Jamaican passport or is ordinarily resident in Jamaica is entitled to additional duty concession in respect of other personal or household effects not specified in (1), (2), (3) above which the proper officer is satisfied are not imported for sale or commercial exchange and do not exceed One Thousand Jamaican Dollars (JA$1,000) in total value. This concession will not be granted to a person who has been permitted duty free importation under this section within the six-month period immediately prior to the date of this return to Jamaica.

What are Personal and Household Effects?

Personal effects are those items which are:

(i) worn on the body, that is, wearing apparel and articles of personal adornment;

(ii) basic to the individual, for example, toilet requisites, medicine.

Household effects are those items basic to the home, for example, furniture, television, radio, stove, and refrigerator.

Personal and household goods which are not in commercial quantities and some other items may be cleared without the services of a licensed Customs Broker. Goods which have a CIF value of the Jamaican equivalent to United States One Thousand Dollars (US$1,000) or less may be cleared without the services of a licensed Customs Broker. The clearance of goods valued in excess of this amount will require the services of a licensed Customs Broker.

Returning Residents (who resided abroad for more than 3 years)

Returning residents who satisfy the under mentioned condition would be eligible for additional duty concessions in respect of personal and household effects and/or tools of trade.

a. be a Jamaican national who has attained the age of eighteen (18) years;
b. have been resident overseas for not less than three (3) consecutive years; and
c. be returning to Jamaica to reside permanently.

Are there any Special Cases?

1. Returning non-Jamaican spouses or persons who qualify as Returning Residents will be afforded the same concession as their Jamaican partner.

2. Returning students who have attained the age of eighteen (18) years and who have studied abroad for more than one (1) year but less than three (3) consecutive years will qualify for concessions in respect of tools of trade and some personal and household effects.

3. Jamaicans who gave up their citizenship (and can provide proof of their previous status) and who return home will be granted the status of a Returning Resident with the attendant benefits.

IMPORTANT INFORMATION FOR RETURNING RESIDENTS

If you intend to return to Jamaica to reside permanently, you should contact the Returning Residents Facilitation Unit at the Ministry of Foreign Affairs and Foreign Trade or any of the Jamaican Embassies or Consulates in foreign countries in order to obtain a copy of the Returning Residents Information Pack.

Your eligibility for concessions as a Returning Resident is established by the Department of Customs. This must be done after your arrival in Jamaica and before you begin the process of clearing your personal and household effects and /or tools of trade.

All goods should be imported within six (6) months before or after the arrival in Jamaica of the Returning Resident.

Please ask at this Unit for the list of concessions to which you are entitled. In order to establish your eligibility for duty concessions, you will be required to submit:

  • your passport;
  • such documentary evidence as may substantiate your permanent residence outside of Jamaica for more than three (3) consecutive years. Note that short visits to Jamaica for vacations, et cetera will not affect your eligibility;
  • such documentary evidence as may substantiate your intention to re-establish permanent residence in Jamaica;
  • in the case of a student, you will also have to provide a letter from your university, college or educational institution confirming the duration of your course of study or time spent at that institution; and
  • the Unaccompanied Baggage Declaration Form (C27) which you received at the airport on arrival in Jamaica.

Import License

Issued by the Trade Board Limited authorising the importation of the motor vehicle. (Telephone: 876-926-3130)

Title

A document issued to the owner of the vehicle by the Government of the country where the vehicle was purchased.

Bill of Lading/Order

Obtained from the shipping agent with information about the particulars of the vehicles, the date it landed in the island and port of entry.

Invoice

For a new motor vehicle (that is, a vehicle under 3,000 miles) an invoice from the supplier is required.

Bill of Sight

This is a document on which details of the motor vehicle being imported are recorded. It is prepared and signed by the owner of broker and certified by the Customs.

Tax Compliance Certificate (TCC)

Obtained from the Revenue Board.

Import Entry – C78

This is the primary import document on which all particulars of the motor vehicle, the name of the importer, shipping information and the duties paid are recorded. It is completed by the broker and submitted to Customs. Only a licensed customs broker should complete this form.

Note: All persons/organisations seeking to import buses into Jamaica must first obtain the approval of the Ministry of Water and Transport.

Customs Examination of Goods

In simple cases involving small shipments or certain classes of goods such as bulk shipments, examination may usually be made on the docks, at container stations, cargo terminals, or the importer’s premises.

The goods are then released to the importer. In other shipments, representative packages of the merchandise may be retained by Customs for appraisal or classification purposes and the remainder of the shipment released.

These packages will also be released to the importer after examination has been completed.

Examination of goods is necessary to determine:

  1. The value of the goods for customs purposes and their dutiable status.
  2. Whether the goods must be marked with the country of their origin or with special marking or labeling. If so, whether they are marked in the manner required. Generally, imported merchandise must be legibly marked in a conspicuous place and in a manner to indicate the English name of the country of origin to the ultimate purchaser in the United States. Certain specific articles are exempt from this requirement.
  3. Whether the goods have been correctly invoiced.
  4. Whether the shipment contains prohibited articles.
  5. Whether requirements of other federal agencies have been met.
  6. Whether goods in excess of the invoiced quantities are present or a shortage of goods exists.

If necessary, goods may be analyzed by a Customs laboratory to determine proper classification and appraisal.

When examination or appraisal of the goods by Customs reveals differences from the entered descriptions in terms of characteristics, quantity or value, or when Customs finds that a different rate of duty than the one indicated by the importer applies, an increase in duties may be assessed.

When all the information has been acquired, including the report of the Customs import specialist as to the customs value of the goods, and the laboratory report, if required, a final determination of duty is made. This is known as liquidation of the entry. At this time, any overpayment of duty is returned or underpayments billed

Duties and Taxes

There are five types of duties and taxes:

Import Duty – Otherwise Called Customs Duty

This is the duty payable on imported goods. The rates of duty are published in the Jamaican Customs Tariff.

Stamp Duty

Postage Stamps amounting to the value of Jamaican Five Dollars ($5) must be affixed on receipts with Cost Insurance and Freight (c.i.f.) value of Five Thousand Five Hundred Jamaican Dollars (J$5,500) and less. For receipts with values above this range, One Hundred Dollars ($100) worth of stamps must be affixed.

Additional Stamp Duty

In an effort to protect local industry, an additional stamp duty is payable on certain items, e.g., meat, chicken, and most chicken parts, pork and some pork products, beef and some beef products; some aluminium products, alcoholic beverages and cigarettes.

General Consumption Tax (GCT) and Special Consumption Tax (SCT)

The General Consumption Tax Act provides for two main types of taxes. These are the General Consumption Tax (GCT) and Special Consumption Tax (SCT). Since October 22, 1991, the General Consumption Tax (GCT) and Special Consumption Tax (SCT) have replaced several duties and taxes, e.g., Excise Duty, CARICOM Duty, Consumption Duty, Entertainment Duty, Retail Sales Tax, Hotel Accommodation Tax, and Telephone Service Tax. GCT is paid on most goods and services except those items which are zero-rated and those which are exempted. SCT is payable on a few items. These are alcoholic beverages, most tobacco products and some petroleum products. Most items attract only GCT, while some attract both GCT and SCT. The petroleum products which attract SCT do not attract GCT.

Where are Duties and Taxes on Imported Goods Paid?

Duties and taxes should be paid to a Customs Cashier at the Customs House or at each clearance point, e.g., wharf or airport. Duties and taxes on imported postal packages should be paid at the Post Office. The duties and taxes on goods requiring a prescribed Import Entry are normally paid at the Customs House and the services of a licensed Customs Broker should be used to undertake this task. Jamaican Customs Duties will only be collected in Jamaica by the Jamaica Customs Department.

Jamaica is a part of CARICOM Caribbean Community and Common Market (CARICOM):

Member states: Antigua & Barbuda, The Bahamas (member of the Community, not the Common Market), Barbados, Belize, Dominica, Grenada, Guyana, Haiti, Jamaica, Montserrat, St. Kitts-Nevis, St. Lucia, St. Vincent and the Grenadines, and Trinidad & Tobago; associate members: B.V.I. and the Turks and Caicos;

Observers: Anguilla, Dominican Republic, Netherlands Antilles, Puerto Rico, Suriname, and Venezuela.

On June 30, 1993, most member states reduced the automobile tariff from 45 percent to 35 percent. The Bahamas, Montserrat, St Kitts-Nevis and Antigua and Barbuda did not adopt the tariff reduction. The Community were supposed to reduce this rate to 20 percent by 1998, with truck tariffs remaining at 10 percent. It is unclear which members actually adopted this change. Belize will implement all tariff reductions two years behind other members, and the Bahamas will continue to maintain its own tariff schedule of 50 percent for automobiles. Customs surcharges, stamp taxes, and consumption taxes vary between countries, but most fall within the 40 to 100 percent range. Jamaica Import Duties

Effective February 1, 1993, Jamaica sharply reduced duty rates on most imported vehicles. Duties currently range from 87.5 percent for cars with engines under 1,000 cc, to 260 percent for cars with engines over three liters and costing in excess of USD 15,000 F.O.B. The 260 percent duty will remain in effect for luxury cars, but will range from50-100 percent for cars under three liters.

Importers may import and license vehicles up to three (3) years old for cars, sport utility vehicles (SUV) and four (4) years old for vans/light commercial vehicles not exceeding two (2) tons at the time of importation. If the vehicle exceeds 2 tons or more; then importers are allowed to import a vehicle up to ten (10) years old. Here are the rules:

a. Passenger vehicles should not be older than three (3) years old, e.g.. Cars, SUV (off road style), Cab Over Van/Wagon, etc.

b. Vans/Light Commercial vehicles should not be older than four (4) years old, e.g. Cab Over Van, Cargo Van, Cab Over Truck not exceeding two tons.

c. Commercial vehicles should not be older than ten (10) years old,  e.g. Cab Over Truck & Big Cab Over Truck exceeding two tons or more.

There is no distinction made between local Jamaican Residents and Returning Residents in the importation of motor vehicles.

Currently any Jamaican over 18 years old can import two motor vehicles (one light commercial vehicle and one motor car) in any three year period.

These can be new or used vehicles, but used vehicles should not be more than three (3) years old in the case of motor cars or four (4) years old in the case of light commercial vehicles, at the time of importation.

A vehicle is considered used if the odometer is registering over three thousand (3,000) miles (4,827 KM), or if it has been pre-owned by a third party, or is over six (6) months old;

A vehicle is considered new if it has been purchased within the period of six (6) months of its manufacture prior to its landing in Jamaica.

Other considerations are as follows:

  • All prospective importers of Classic/Antique/Limited Edition Motor Vehicles MUST obtain an import permit prior to arrival of the Vehicle. Each application must be supported by the Jamaica Classic Car Club, along with documentary proof that the unit falls into definition and categories as specified by the Motor Vehicle Import Policy.
  • All prospective importers of vehicles for agricultural use who seek duty concessions, MUST FIRSTobtain approval of Rural Agricultural Development Agency (RADA) Parish offices in the locale of the farming activity prior to importation. The Trade Board requires evidence of any concession granted at the time the relevant Motor Vehicle Import Licence application is submitted for approval.
  • A Certificate of Fitness will only be required for motor vehicles to be imported from a country where it is a statutory requirement that vehicles be examined and certified prior to shipment.
  • An import licence is NOT required for the importation of oversized vehicles (heavy-duty Trucks, Tractors and Trailers – three (3) tons and over unladen weight). However, importers MUST FIRST obtain written permission from the Island Traffic Authority, BEFORE importing such units.
  • All persons seeking to import vehicles with six (6) seats and over, with the exception of Jeep, Pajeros, Pathfinders and similiar type vehicles, MUST FIRSTobtain the approval of  the Ministry of Industry, Commerce & Technology.
  • All vehicles originating in countries where they drive on the right MUST:
    • – where applicable modify their units for passengers to enter/exit on the curbside of the road;
    • – modify the beam of the headlamps to reflect down on the left horizontal plane or up and down on the vertical plane.
  • Vehicular air-conditioning equipment containing chloroflourocarbons (cfcs) are prohibited from importation into Jamaica.
  • Import Licences issued by the Trade Board Limited are valid for the duration of the Financial Year in which they are granted i.e. the period April 1st to March 31st of any given year or remaining portion thereof.
  • All Import Licences (except for approved Motor Vehicle Dealers) will be claused against sale or transfer of the unit (vehicle) for a period of one (1) year after its arrival..

Please note that revisions to the law have also greatly facilitated the acquisition of new or used vehicles through an approved motor dealer or a certified used car dealer in Jamaica, either from stock or by special order. Most makes/models of vehicles are now available in Jamaica thereby providing an OPTION for consideration when decisions are being taken about personal importation of vehicles and the attendant shipping and clearance arrangements.

The Motor Vehicle Importation Policy is primarily administered by the Trade Board Limited, which is the Government Agency responsible for granting the Order and Clearance Permit or Import Licence you will require to bring a motor vehicle into Jamaica. Contact may be with this authority on any question regarding the importation of vehicles at the addresses provided in the Information Pack Directory.

An importer must apply to the Trade Board for an Import Licence, and obtain approval BEFORE shipping the vehicle. You must also secure the services of a licensed Customs Broker to clear the vehicle on arrival – an individual is not permitted to do this.

The procedures to be carried out in making an application for a Motor Vehicle Import Licence are as follows:

The importer must first obtain an Import Licence Application Form from the Trade Board. Sets of forms (in triplicate) are available for a fee of J$35. A sample of this form (The Order and Clearence Permit) is included in the Information Pack.

The application should be completed in triplicate and returned to the Trade Board for processing accompanied by the following items:

  • If the vehicle is new, you should get a pro-forma invoice from the dealer, detailing model, accessories, and c.i.f. value;
  • If you already own the vehicle you should provide a certificate of title or registration document;
  • You should provide certified copies of two (2) valid forms of identification which may be any of the following:
    • – Passport (Jamaican – Pages 1-5; non-Jamaican – pages up to expiry date)
    • – Driver’s Licence (both sides)
    • – National Voter’s Identification Card
  • A* Taxpayer Registration Number (TRN) is also required (photocopy of both sides of the card should be attached)

Import Licence Collection    

Once an application is received at the Trade Board, it is generally processed within twenty-four (24) hours and is available for collection at the Trade Board locations to which it was directed for processing in Kingston or in Montego Bay. If you are unable to collect the Permit in person, please note that:

the Trade Board will facilitate delivery to a Licensed Customs Broker acting on the importer’s behalf, upon presentation of proper identification; or, to an individual with a letter of authorization from the importer and proper identification.

Once this document has been collected, the importer can complete his shipping and clearance activities within a reasonable period. Vehicles may be shipped to any port of entry.

Anyone who imports any motor vehicle without first obtaining a valid Order and Clearance Permit will be liable to a fine equivalent to three times the value of the motor vehicle, plus seizure of the vehicle.

Documentation and Procedure for Clearance

Your Licensed Customs Broker will be responsible for the clearance of the vehicle from the port of entry. He or she will advise you of the procedure to be followed, the information required, and the costs involved for the services to be provided.

For a new motor vehicle, you can estimate the amount of Customs Duty you will have to pay on your vehicle by applying the relevant Aggregate Customs Duty rate to the value on the supplier’s pro-forma invoice.

In the case of used vehicles the depreciated value applicable to the age and mileage of the vehicle can be referenced from Glass’s Guide – for vehicles being shipped from the U.K. and Europe, and the N.A.D.A. Book – for vehicles being shipped from North America, i.e., the United States and Canada. (For further information on the duty assesment process contact the Jamaica Customs (Motor Vehicle Unit) at the address listed in this Information Pack or contact the Jamaican Overseas Department).

After the vehicle is landed, the necessary documentation should be obtained and given to a Licensed Customs Broker who will interact with the Customs Department on behalf of the importer.

When the documents have been processed by the Customs Department and found to be correct, the licensed customs broker will make payment of all duties, taxes, etc. on your behalf. The broker may then proceed to the clearance point (e.g. wharf, airport, etc.) and effect clearance of the vehicle.

Apart from the Import Licence issued by the Trade Board, which authorizes the importation of the motor vehicle, the following is also required:

Title / Registration Certificate:  Ownership documents which helps to classify the motor vehicle for valuation purposes and is provided by the owner.  

Invoice:  For a new motor vehicle (under 3000 miles) an invoice is needed from the supplier.  

Bill of Lading:   Provides information about the particulars of the vehicle, the date it landed in the island, and at which port of entry. This is obtained from the Shipping Agent.  

Bill of Sight:   This is a document on which details of the motor vehicle being imported are recorded. This is obtained from a Licensed Customs Broker.  

Taxpayer Registration Number (TRN):   A unique nine digit identification number required for the transaction of business with all government Revenue Departments (including Customs, Trade Board). This is obtained from the Revenue Board.  

Tax Compliance Certificate (TCC):   A document issued as proof that payments of tax liabilities and wage-related statutory deductions are up-to-date. This is obtained from the Revenue Board.  

C78/Import Entry:   This is the primary import document on which all particulars of the motor vehicle, the importer, shipping information, etc. are recorded. This is prepared and submitted to Customs by a Licensed Customs Broker.  

Putting the vehicle on the Road:

Before driving on the public road, prior to removing the motor vehicle from the wharf, you should obtain motor insurance coverage through an insurance agency or broker.

On clearing the vehicle, and having paid the relevant fee at the nearest Taxpayers Service Centre or Collector of Taxes of the Inland Revenue Department, a Certificate of Fitness should be obtained from a Motor Vehicle Examination Depot to indicate that it complies with Jamaican standards, for example, please note that in the case of vehicles imported from North America and other territories where one drives on the right side of the road, it is necessary to adjust or change the vehicle’s headlights prior to presenting it for examination.

Finally, the insurance cover note or certificate, the Certificate of Fitness, and the Import Entry Documentation should be taken to the Taxpayers Service Centre so that the vehicle can be registered, registration plates purchased, and an application made for a Title of Ownership of the vehicle. Each of these items attracts a fee.

Drivers should note that if you do not already have a valid Jamaican driver’s licence, you can drive in Jamaica on a valid overseas licence for one (1) year only before it is necessary to secure a Jamaican licence.
